WALNUT STREET FAIR 2020 VENDOR APPLICATION

If you are interested in becoming a vendor at the Walnut Street Fair, please fill out the form below. Upon receipt of your application, someone from the Walnut Street Fair Committee will reach out to you to let you know if your application to be a vendor is approved.  

FAIR INFORMATION

DATE: Sunday May 3, 2020 / Rain or Shine

LOCATION: The 2020 Walnut Street Fair will be held on Walnut Street, from the top of Forest Street down to Grove Street in Montclair, NJ.

FAIR HOURS: 12pm - 5pm

SET UP/BREAKDOWN: Set-up begins at 10 am and all vendors must be off the street and cleaned up by 6 pm.

RAIN DATE: This is a rain or shine event. Every effort will be made to have the fair. If weather causes the fair to be cancelled, there will be no rain date or refunds.  In the event of rain, the fair will be cancelled at 8 AM. Call 973-746-2499 after 8AM.

 

APPLICATION FEES (For Approved Vendors)

Craft and Retail Vendors:

Booth Size 10 X 10 Curbside Area

$150 fee (non-refundable) + Applicable licenses and permits, depending on business type. 

 

Food Vendors and Food Trucks:

Booth Size 10 X 10 Curbside Area

$200 fee (non-refundable) + Applicable licenses and permits, depending on business type. 

 

Business Promotional: 

Booth Size 10 X 10 Curbside Area

$200 fee (non-refundable) + Applicable licenses and permits, depending on business type. 

 

Retail Vendor Selling New Items Double Space:

Booth Size 20 X 10 Curbside Area

$300 fee (non-refundable) + Applicable licenses and permits, depending on business type. 

 

Non-Profit Booth - (Max 10 non-profits)

Size 10 X 10 Curbside Area

$75 fee (non-refundable) 

 

  • Tables will not be provided for vendors.  Each vendor is responsible for their own display and table. Tents are welcomed as long as they fit within your allocated 10x10 space. 
  • Acceptance into fair is contingent on submission and approval of completed application, fees as detailed above, signed liability waiver, and proof of all applicable licenses and permits.  The Walnut Street Fair Chairs will contact you once your application is approved and will provide payment details and next step information.
  • Receipt of your application will be confirmed in writing.  No refund will be made for any other reason. Proceeds from the sales of these spaces will be used for charitable projects by the Junior League of Montclair-Newark, Inc.
  • All payments, from approved vendors, must be received by April 3, 2020.
  • All permits, from approved vendors, must be submitted to the JLMN Office by April 17, 2020.
  • Payment information will be emailed to approved vendors.

Prohibited Items and Transactions Include: 

  • The selling of ALL toys of violence
  • Any CBD product
  • Any vaping/tobacco products
  • Roving vendors
  • Any business or item the JLMN deems inappropriate for the fair
  • The JLMN has the right to refuse a vendor for any reason or just cause
  • Vendors not appropriate for a family event
  • Vendors incompatible with the Junior league of Montclair-Newark, Inc. mission
  • Commercially produced items, or mass-produced items
PERMIT INFORMATION

Every vendor must obtain the appropriate town permits and submit to the JLMN office* by April 17, 2020. Upon approval of your application, we will contact you with the necessary license/permit info.

*Fire Safety (all food vendors) and Hood & Suppression (food trucks only) Permit applications and payments must be mailed to Township of Montclair LEA - Fire Prevention Bureau – One Pine Street – Montclair, NJ 07042

  • Montclair Business with Brick and Mortar Store in Town

JLMN will submit business name with Township of Montclair for Local Merchant License.  No fee or application associated with this license.

 

  • Retail Vendors / Craft & Art Vendors with no Montclair Storefront

*Mobile food vendors need both an Open flame/Propane Permit & a Hood Suppression Permit and must be inspected prior to the event at the Montclair Fire Department no less than a week prior to the event, an appointment can be scheduled by calling 973-509-4769. Payment is due upon passing the inspection and can be made by check/money order payable to “Township of Montclair, LEA” 1 Pine Street, Montclair, NJ 07042.

VENDOR TERMS & AGREEMENT

o   Vendor space is limited, available spaces are issued on a first-come basis. JLMN has the right to assign all Booth Space. Booth Space will be assigned as JLMN sees fit and is non-negotiable.

o   Every vendor must obtain the appropriate insurance and necessary permits.

o   Vendor, agrees to provide receptacles for garbage and to ensure that the area surrounding your booth is clean and free of all debris at the close of the fair. Failure to leave the area clean may jeopardize your participation in future events. Please plan to take your garbage with you.

o   On Sunday May 3rd, Vendor check-in is from 10:00AM-11:30AM. Merchant is required to remove all merchandise and equipment from the premises between 5:00 PM and 6:00 PM the same day.  Vendor agrees that its booth(s) will be staffed by Vendor and/or its representatives(s) and will be open for business during the hours of 12PM-5PM.

o   JLMN shall be permitted to use Vendor's name and/or address and any other information deemed appropriate by the JLMN in connection with the advertising and promotion of the Street Fair.  In addition, in the event that JLMN uses a written program in connection with the Street Fair, JLMN may list Vendor's name, address and any other information in any such program.

o   JLMN retains the right to terminate this Contract and/or remove Vendor if Vendor fails to abide by the conditions set forth in this Contract.  Upon being notified of such termination, Vendor agrees to remove its merchandise and equipment from the Street Fair at Vendor’s expense. Vendor agrees to seek no legal recourse against JLMN for the termination of this Contract and/or removal of Vendor, its merchandise and equipment or for any claim of injury, loss or damage resulting there from.

o   JLMN may cancel the Walnut Street Fair at any time at its sole option.  JLMN shall not be responsible to Vendor for any expenses or loss of anticipated profits or any other amount of damages or loss under any circumstances due to cancellation of the Street Fair.  As set forth herein, JLMN will not return any reservation fees if Vendor cancels its appearance at the Street Fair.

o   JLMN makes no representations to Vendor as to the exclusivity of Vendor’s merchandise and/or equipment.  JLMN does not control whether another Vendor will sell similar or identical items during the course of the Street Fair. 

o   Loading and Unloading zones will be provided during Street Fair set-up and break down. Parking during the Street Fair is at the responsibility of the Vendor as no parking is provided.

 

WAIVER OF LIABILITY AND INDEMNITY

As a Walnut Street Fair vendor, I/we understand; agree to the following in order to participate in the Walnut Street Fair activities sponsored by JLMN. 

I/we understand that in order to participate, I/we (the vendor) assume all responsibility and risk associated with all conditions, hazards and potential dangers in, on or about a site, whether they are open and obvious or concealed. 

I/we hereby RELEASE, DISCHARGE, AND WAIVE, any claims, actions or suits of any character, name and description, that I/we may have against JLMN, its directors, officers, volunteers, agents and employees and owners/lessees of a site, as a result of any injuries, damages or death received or sustained by me/us in connection with the services performed on, in or while I/we am participating in any Walnut Street Fair activities. 

I/we hereby agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS, JLMN, its directors, officers, volunteers, agents and employees and all owners/lessees of a site from and against any and all liabilities, losses, claims,expenses (including reasonable attorney fees), damages, obligations, judgments, or deficiencies of every kind and description, contingent or otherwise, resulting from or arising out of any of my (our) acts or failure to act in connection with the Walnut Street Fair activities. 

ALL VENDORS 

As a Walnut Street Fair vendor, I/we understand that all vendors must have any required license, general liability, workers compensation coverage (if applicable) and be prepared to undergo a safety/health inspection on site. I/we understand it is our responsibility to comply with all of these requirements and deliver a certificate of insurance naming JLMN as additional insured in regards to general liability coverage, if applicable. This certificate must be delivered by April 19, 2019. I/we understand it is our responsibility to comply with all of these requirements.
